Terms and Conditions

1. Definitions

In these Terms and Conditions:

‘goods’ includes IWASHWISH Smart Bidet Toilet Seat.

‘services’ includes customer service.

‘we’ or ‘us’ means IWASHWISH .

‘website’ means IWASHWISH official website: iwashwish.com.au 

2. General

2.1 These Terms and Conditions apply to any purchase of goods or services from IWASHWISH through the website.

2.2 These Terms and Conditions may be amended periodically and the customer will be deemed to have accepted any amendments if you use the website after those amendments have been posted.

3. Contract and price

3.1 All prices displayed on the website are in Australian Dollars and inclusive of GST, unless otherwise indicated.

3.2 Description of goods, services and prices may be subject to change or correction at any time. Although IWASHWISH seeks to ensure information is correct, IWASHWISH makes no representation or warranty as to information being accurate or complete. If IWASHWISH discovers an error (e.g. goods or services are displayed for the wrong price), IWASHWISH will try to notify the customer as soon as possible and allow the customer to cancel the order and obtain a refund if desired. The customer may be required to provide credit card details to IWASHWISH for the purpose of issuing a credit to the customer’s credit card account in the amount of any cancelled order.

3.3 By submitting an order via the website the customer warrants that:

  • they are capable of entering into a legally binding contract with IWASHWISH,
  • they are authorised and able to make payment via the method they have chosen,
  • the payment information they have provided is correct, and
  • the purchase is not made for the purpose of commercial resale.

3.4 A contract for purchase is only formed once IWASHWISH have accepted an order by issuing a receipt number.

4. Payment method

4.1 Payment can be made with valid credit cards (Amex, Visa, Mastercard). IWASHWISH will deduct all amounts owing at the time of processing the customer’s order. 

4.2 If IWASHWISH is unable to deduct from the customer’s credit card the total amount owing to IWASHWISH in one transaction, IWASHWISH may process any number of transactions on the customer’s credit card until the total amount owed is paid.

5. Delivery

5.1 An outgoing delivery of tangible goods will usually take 2 working days after acceptance of an order. However sometimes goods or services can be temporarily or permanently unavailable due to circumstances outside IWASHWISH ’s control. 

5.2 IWASHWISH is not liable for any loss or damages arising from delays in delivery or failure to deliver the goods to the customer (although the customer may request a refund if he/she does not receive goods properly ordered: see section 6 below).

5.3 Outgoing deliveries are sent using Australia Post. Complimentary postage is applied for standard deliveries to all Australian locations excluding Northern Territory, Perth Metro, Queensland Far North, Western Australia regional, Western Australia remote and Tasmania.

5.4 We do not ship goods to addresses outside Australia. 

6. Refund/cancellation policy

6.1 Should the customer receive incorrect, damaged or faulty goods, the customer is to contact info@iwashwish.com.au within 7 days of receipt and IWASHWISH will arrange, as appropriate and depending on availability, a goods exchange, credit or refund. 

6.2 IWASHWISH may require proof of purchase, photographs and/or videos of the good before actioning an exchange, credit or refund request. 

6.3 IWASHWISH will be pleased to consider exchange, credit or refund for other reasons, however the decision whether to grant this will be at IWASHWISH ’s discretion. 

6.4 Any refund will be made using the customer’s original payment method or another method at our discretion.

7. Guarantees and Limitation of Liability

7.1 The customer shall receive the benefit of all warranties and conditions which are implied by law and which IWASHWISH may not lawfully exclude under the Australian Consumer Law. Subject to but to the fullest extent permitted by law, IWASHWISH excludes all other implied warranties and conditions and limits it liabilities for a breach of an express or implied term, condition or warranty of this contract to the replacement or repair of the goods or the cost of replacing or repairing the goods, excluding any shipping charges.

7.2 The customer is entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure within two years from the date of purchase. Defects and failures not covered by warranty include but are not limited to: (i) Damage due to user misuse or use in a manner contrary to the operating instructions (ii) Improper or neglected maintenance including cleaning where required (iii) Cuts and scratches including those caused by opening packaging with blades or knives.

7.3 Within 30 days of the customer receiving the goods, goods must be returned in their original packaging, and in the same condition in which it was received, it should include all items that were in the original package and must not have been damaged during the time the good is in the customer’s possession, up until IWASHWISH receives the product. 

7.4 Returned goods that are used, damaged, missing any parts, or is damaged in transit due to packaging deficiencies may fall subject to a deduction from the refund amount to cover the amount of loss. 

7.5 Goods are to be returned at the expense of the customer and comply with the directions for returning the product. The product will remain the customer’s responsibility during transit until it is received at the IWASHWISH address supplied. IWASHWISH does not accept any liability for any loss or damage which may occur during transit.

7.6 After receiving the returned product, IWASHWISH will issue a refund as soon as is reasonably practicable and the customer will be provided with e-mail acknowledgement.

8. Law

8.1 These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.
